EULA does appear as black screen - to fix that launch in desktop mode and accept, then you can keep playing in game mode

set the ingame settings resolution to 640x400 and upscaling to FSR
There was problems with black screen and game not appearing on desktop and gaming modes. Setting lanuch resolution from default to 1920 fixed the problem.
